The provision of fair and timely wages, along with supporting welfare facilities, remains an issue that has not yet been fully realized in Bengkalis Regency. Various factors influence the effectiveness of this regulation in ensuring the proper payment of wages to local workers. Therefore, this study examines five factors influencing legal effectiveness as proposed by Soerjono Soekanto and reviews the implementation of wage distribution for local workers in Bengkalis Regency by employers. In addition to employers, the regional government through collaboration between the Regent and other local institutions, such as the Department of Manpower and Transmigration of Bengkalis Regency and the Technical Implementation Unit of Manpower, can play a a role in taking preventive and repressive measures to achieve the effectiveness of Bengkalis Regency Regional Regulation Number 3 of 2022 (Perda Kab. Bengkalis No. 3/2022. This study further identifies the causes of non-compliance in wage provision for local workers and proposes solutions to ensure the objectives of the regulation can be met. Accordingly, the solutions offered by this research aim to provide stronger protection for local workers in Bengkalis Regency and to advance the welfare of the local community.</p> <p>[<em>Penelitian mengenai efektivitas penerapan Peraturan Daerah Kabupaten Bengkalis Nomor 3 Tahun 2022 terhadap pemberian upah tenaga kerja lokal dilakukan agar pembayaran upah tenaga kerja lokal di Kabupaten Bengkalis dapat sesuai dengan peraturan perundnag-undangan yang berlaku dan memberikan kesejahteraan bagi tenaga kerjanya. Pemberian upah tenaga kerja yang sesuai dan tepat waktu serta fasilitas penyokong kesejahteraan lainnya menjadi hal yang masih belum dilakukan di Kabupaten Bengkalis. Banyak faktor yang mempengaruhi efektivitas pelaksanaan Perda ini dalam pemberian upah tenaga kerja lokal yang sesuai, sehingga penelitian ini akan mengkaji 5 faktor yang mempengaruhi efektivitas hukum milik Soerjono Soekanto dan meninjau pelaksanaan pemberian upah tenaga kerja lokal di Kabupaten Bengkalis oleh pengusaha. Bukan hanya pengusaha, pemerintah daerah melalui kerja sama Bupati dan perangkat-perangkat daerah lainnya, seperti Dinas Ketenagakerjaan dan Transmigrasi Kabupaten Bengkalis dan Unit Pelaksana Teknis Ketenagakerjaan dapat berperan dalam mengambil langkah preventif dan represif agar efektivitas pelaksanaan Perda Kab Bengkalis No. 3 Tahun 2022 dapat tercapai. Employing a normative–empirical legal approach, the research analyzes both the regulatory foundations and the practical implementation of KKR Aceh’s mandate as outlined in Law No. 11 of 2006 on the Governance of Aceh and Qanun Aceh No. 17 of 2013. Data were obtained from statutory regulations, official reports, and scholarly literature. The normative analysis focuses on the institutional design, legal legitimacy, and alignment of KKR Aceh with Indonesia’s constitutional principles and international human rights standards. Meanwhile, the empirical analysis evaluates its achievements in documenting human rights abuses, organizing public hearings, and recommending reparations for victims. The findings indicate that KKR Aceh has made substantial progress in restoring victims’ dignity and encouraging societal healing. However, its capacity remains limited due to legal, financial, and institutional challenges, including dependency on special autonomy funds and lack of coordination with national agencies. The study concludes that reinforcing KKR Aceh’s legal framework, ensuring continuous funding, and integrating reconciliation education are vital for strengthening transitional justice and sustaining peace in Aceh.</p> <p> </p> <p>[<em>Tujuan penelitian ini adalah menilai efektivitas KKR Aceh sebagai mekanisme keadilan transisional di tingkat lokal, terutama dalam memajukan pengungkapan kebenaran, pemulihan korban, dan rekonsiliasi sosial. Dengan menggunakan pendekatan hukum normatif-empiris, penelitian ini menganalisis landasan hukum serta implementasi praktis mandat KKR Aceh sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh dan Qanun Aceh Nomor 17 Tahun 2013. Data penelitian diperoleh dari peraturan perundang-undangan, laporan resmi, dan literatur akademik. Analisis normatif menitikberatkan pada legitimasi hukum, desain kelembagaan, serta kesesuaian KKR Aceh dengan prinsip konstitusi dan standar hak asasi manusia internasional. Sementara itu, analisis empiris menilai pencapaian lembaga ini dalam mendokumentasikan pelanggaran HAM, menyelenggarakan sidang kesaksian publik, serta memberikan rekomendasi reparasi bagi korban. Hasil penelitian menunjukkan bahwa KKR Aceh telah berkontribusi signifikan dalam memulihkan martabat korban dan memperkuat rekonsiliasi sosial. Namun, efektivitasnya masih terbatas akibat kendala hukum, keuangan, dan kelembagaan, termasuk ketergantungan pada dana otonomi khusus dan lemahnya koordinasi dengan lembaga nasional. This money is used as wedding expenses in preparation for the marriage ceremony. The tradition symbolizes respect and honor toward women. This study examines the influence of Bugis women’s educational level on the amount of <em>uang panai’</em> within the Bugis community in Kateman District, Riau, where the majority of residents are not ethnically Bugis. The research employs a qualitative ethnographic approach and uses the theory of acculturation as an analytical framework. The findings reveal that the higher the woman’s educational attainment, the greater the amount of <em>uang panai’</em> requested by her family as a form of social appreciation. However, in a non-Bugis dominant environment, this practice has undergone adaptation through interfamily negotiations. Consequently, the <em>uang panai’</em> amount among Bugis women in Kateman District differs from that in Bugis communities in Sulawesi. Acculturation plays a key role in maintaining the continuity of the tradition while allowing flexibility in its practice.</p> <p><em>[</em><em>Tradisi uang panai’ merupakan salah satu tradisi yang ada dalam perkawinan masyarakat Bugis, yaitu berupa pemberian sejumlah uang dari pihak laki-laki kepada pihak perempuan, yang dipergunakan sebagai uang belanja untuk mempersiapkan acara perkawinan. Tradisi ini mempunyai arti sebagai bentuk sebuah penghargaan dan penghormatan kepada pihak perempuan. Penelitian ini membahas pengaruh pendidikan perempuan Bugis terhadap nominal uang panai’, dalam tradisi masyarakat Bugis di Kecamatan Kateman, Riau, yang mayoritas bukan bersuku Bugis. Penelitian menggunakan pendekatan kualitatif etnografi, dan menggunakan teori Akulturasi sebagai pisau analisis. Hasil penelitian menunjukkan bahwa, semakin tinggi pendidikan perempuan, semakin besar nominal uang panai’ yang diminta keluarga sebagai bentuk penghargaan sosial. Namun, dalam lingkungan yang bukan mayoritas Bugis ini, ternyata mengalami penyusuaian melalui negosiasi antar keluarga. Sehingga nominal uang panai’ perempuan Bugis di Kecamatan Kateman, memiliki perbedaan besaran nominal, jika dibandingkan dengan masyarakat Bugis yang ada di Sulawesi. Akulturasi berperan dalam menjaga bagaimana tradisi tetap dijalankan sekaligus menungkinkan fleksibilitas dalam praktiknya.</em><em>]</em></p> Siti Rohani Copyright (c) 2025 Siti Rohani https://creativecommons.org/licenses/by-sa/4.0 2025-11-22 2025-11-22 8 4 789 799 10.58824/mediasas.v8i4.471 A Juridical Analysis of Constitutional Court Decision No. 39/PUU-XVIII/2020 on Regulatory Imbalances between Conventional Television Broadcasting and Over-The-Top Media from the Perspective of Justice https://www.journal.staisar.ac.id/index.php/mediasas/article/view/479 <p>The advancement of digital technology has given rise to internet-based Over The Top media services that operate outside the broadcasting regulatory framework governing conventional television as stipulated in Law Number 32 of 2002. This regulatory imbalance creates concerns of injustice, as conventional television broadcasters bear heavier legal obligations compared to digital platforms. The disparity prompted a judicial review petition before the Constitutional Court through Case Number 39/PUU-XVIII/2020. The research addresses two core issues: the legal considerations of the Constitutional Court in reviewing Article 1 point 2 of the Broadcasting Law, and the juridical basis of the Court’s decision concerning the differential treatment between conventional television broadcasting and Over The Top media services from the perspective of justice. The study aims to analyze the Constitutional Court’s decision through a philosophical-juridical approach by employing John Rawls’s theory of justice and the principles of Islamic Legal Philosophy to assess the extent to which the ruling aligns with substantive justice. This research adopts a normative legal method using primary and secondary sources collected through literature review, observation, interviews, and documentation. The data were analyzed qualitatively to elaborate on the Court’s legal reasoning, the regulatory context, and the justice implications of the decision. The findings show that the Constitutional Court rejected the judicial review petition on the grounds of fundamental technical differences between conventional broadcasting and Over The Top services, thereby excluding digital platforms from the scope of the Broadcasting Law. The analytical assessment reveals that although the ruling is formally valid, it does not fully achieve substantive justice. Rawlsian evaluation demonstrates a violation of the Difference Principle due to the creation of unequal competitive conditions disadvantaging national broadcasters. Meanwhile, Islamic Legal Philosophy, through the concepts of al-maslahah and taw?zun, emphasizes the need for balanced social and moral responsibilities that are not yet addressed within the current legal framework. The implications of this study highlight the urgency of comprehensive and adaptive media law reform to respond to digital transformation. Regulatory renewal is required to ensure distributive justice, strengthen the protection of national broadcasting industries, and uphold public welfare amid the rapidly evolving internet-based media ecosystem.</p> <p>[<em>Perkembangan teknologi digital melahirkan layanan media Over The Top berbasis internet yang beroperasi tanpa berada dalam rezim pengaturan penyiaran sebagaimana televisi konvensional yang diatur melalui Undang-Undang Nomor 32 Tahun 2002. Ketidakseimbangan regulasi tersebut memunculkan persoalan keadilan karena televisi konvensional menanggung kewajiban hukum yang lebih berat dibandingkan platform digital, sehingga diajukan pengujian norma melalui perkara Mahkamah Konstitusi Nomor 39/PUU-XVIII/2020. Permasalahan penelitian ini mencakup dua hal, yaitu pertimbangan hukum Mahkamah Konstitusi dalam memutus pengujian Pasal 1 angka 2 Undang-Undang Penyiaran serta dasar yuridis putusan tersebut terhadap perbedaan perlakuan antara penyiaran televisi konvensional dan media Over The Top dalam perspektif keadilan. Penelitian ini bertujuan menganalisis putusan Mahkamah Konstitusi secara filosofis-yuridis menggunakan teori keadilan John Rawls dan prinsip-prinsip Filsafat Hukum Islam untuk menilai kesesuaian putusan dengan prinsip keadilan substantif. Penelitian menggunakan metode normatif dengan sumber data primer dan sekunder, diperoleh melalui studi pustaka, observasi, wawancara, dan dokumentasi. Analisis data dilakukan secara deskriptif kualitatif untuk menguraikan argumentasi hukum, konteks regulasi, dan implikasi keadilan dalam putusan tersebut. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi menolak permohonan uji materiil atas dasar perbedaan karakteristik teknis antara penyiaran televisi dan layanan Over The Top sehingga platform digital tidak termasuk dalam cakupan Undang-Undang Penyiaran yang berlaku. Temuan analitis menunjukkan bahwa putusan tersebut, meskipun sah secara formal, belum sepenuhnya memenuhi prinsip keadilan substantif. Telaah berdasarkan teori Rawls menegaskan adanya pelanggaran terhadap prinsip perbedaan karena terciptanya ketidakseimbangan kompetisi antara pelaku penyiaran nasional dan penyedia layanan digital. Perspektif Filsafat Hukum Islam melalui konsep al-maslahah dan taw?zun mengharuskan adanya keseimbangan tanggung jawab sosial yang belum terakomodasi dalam putusan tersebut. Growth so that it really needs the loyalty and trust of the community. This loyalty and trust transformed Islamic banks before entering the maturity phase. This includes financing the procurement of motor vehicles that can ease the community. The purpose of this research is to find out what contracts are contained in the financing. Is the theory in accordance with the practice in the field? The results of this study concluded that there was contract engineering in OTO financing at Sharia Banks, making it widely criticized by the public. If in practice two contracts are used, it must be explained at the beginning, and the gem contract must be adjusted, however, what happens in the field is not as written. Therefore, the author concludes that OTO financing is contrived by the contract and is not in accordance with sharia.</p> <p>[<em>Saat ini, perbankan syariah di Indonesia merupakan bagian dari sektor jasa keuangan utama yang sedang memasuki fase baru pertumbuhan sehingga sangat membutuhkan loyalitas dan kepercayaan masyarakat. Loyalitas dan kepercayaan tersebut menjadi faktor penting dalam mendorong transformasi perbankan syariah sebelum memasuki fase kematangan. Chairul Annas https://creativecommons.org/licenses/by-sa/4.0 2025-11-29 2025-11-29 8 4 818 830 10.58824/mediasas.v8i4.474 Period of ‘Iddah Of Woman In Khulu’ Perspective Of Ibn Qayyim Al-Jauziyyah and Ibn Hazm https://www.journal.staisar.ac.id/index.php/mediasas/article/view/481 <p>This study&nbsp; discusses the waiting period (‘Iddah) of a woman who initiates divorce through <em>khulu’</em> according to the perspectives of two prominent scholars, Ibn Qayyim al-jauziyyah and Ibn Hazm. <em>Khulu’ </em>is a form of divorce initiated by the wife with compensation (iwadh) given to the husband. The main issue addressed in this research is the differing opinions between the two scolars regarding the length of the ‘iddah for women who undergo khulu’. Ibn Qayyim asserts that the ‘iddah period is one menstrual cycle, while Ibn Hazm maintains it should be three quru’. This research employs a qualitative method with a library research approach and comparative analysis. The findings indicate that the divergence arises from the difference in their legal reasoning methods: Ibn Qayyim adopts ta’lil (reason-based analogy) and qiyas, while Ibn hazm adheres strictly to the literal meaning of the texts. Although the State Civil Apparatus Law outlines material and non-material entitlements for ASN in general, each category of personnel does not yet receive equal access to pension security. This disparity creates problems of fairness, legal certainty, and state accountability in protecting ASN as public service providers. This study aims to explore the legal protection of equal pension rights for PNS and PPPK through a constitutional law review and the application of the maslahah mursalah principle. The research employed a normative juridical method by examining statutory regulations, legal doctrines, court decisions, and relevant literature. The findings reveal that existing pension regulations do not ensure equal legal protection between PNS and PPPK, resulting in welfare disparities within the ASN system. Through the perspective of maslahah mursalah, pension benefits for all ASN constitute a form of public interest that promotes humane treatment after years of service, provides psychological security regarding future planning, and reduces the risk of socio-economic vulnerability in old age. The implications of this study highlight the urgency for regulatory harmonization of pension schemes to ensure equality between PNS and PPPK, reflecting distributive justice, legal protection, and improved governance of the ASN system in Indonesia.</p> <p>[<em>Ketimpangan perlindungan hukum terkait kesetaraan hak jaminan pensiun antara Pegawai Negeri Sipil (PNS) dan Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) masih menjadi persoalan krusial dalam tata kelola Aparatur Sipil Negara (ASN) di Indonesia. Walaupun Undang-Undang Aparatur Sipil Negara telah menetapkan hak materiel dan nonmateriel bagi ASN secara umum, masing-masing kategori pegawai belum sepenuhnya memperoleh jaminan hak yang setara, khususnya dalam aspek jaminan pensiun. Kondisi ini menimbulkan problem keadilan, kepastian hukum, serta konsistensi perlindungan negara terhadap ASN sebagai pelaksana layanan publik. Penelitian ini bertujuan untuk mengkaji perlindungan hukum terhadap kesetaraan hak jaminan pensiun bagi PNS dan PPPK melalui tinjauan hukum tata negara dan pendekatan prinsip maslahah mursalah. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan menelaah peraturan perundang-undangan, doktrin hukum, putusan, dan literatur relevan. Hasil penelitian menunjukkan bahwa pengaturan jaminan pensiun belum memberikan kesetaraan perlindungan hukum antara PNS dan PPPK, sehingga menimbulkan disparitas kesejahteraan bagi ASN. Melalui analisis konsep maslahah mursalah, jaminan pensiun bagi seluruh ASN menjadi bagian dari kemaslahatan publik karena memberikan perlakuan manusiawi setelah masa pengabdian, menciptakan rasa aman psikologis terhadap perencanaan masa depan, serta mengurangi risiko kerentanan sosial dan ekonomi pada usia lanjut. One notable factor is the influence of social media on attitudes, emotions, and marital relationships. This study aims to analyze the implications of social media on the increase in divorce lawsuits and review them from the perspective of <em>maq?</em><em>?id al-syar?'ah</em> in Islamic family law. Using a qualitative approach and data collection techniques in the form of interviews and documentation, it was found that social media often triggers conflict, either through access to information in the form of legal awareness that strengthens the wife's courage to file for divorce or because of evidence of infidelity and the tendency to compare one's household with that of other couples (social comparison). The <em>maq?</em><em>?id al-syar?'ah</em> perspective views divorce as a form of protection for the soul, mind, and offspring that can threaten the psychological well-being of children. <em>M</em><em>aq?</em><em>?id al-syar?'ah</em> does not directly legitimize divorce as the main solution, but emphasizes the importance of conflict prevention and strengthening relationships within the family. This study affirms the importance of digital literacy and an Islamic legal approach that is responsive to social change.</p> <p> </p> <p>[<em>Fenomena meningkatnya cerai gugat oleh istri di Kota Ternate menunjukkan adanya pergeseran dinamika sosial dalam rumah tangga Muslim. Salah satu faktor yang mencolok adalah pengaruh media sosial terhadap sikap, emosi, dan hubungan suami istri. Penelitian ini bertujuan untuk mengalisis implikasi media sosial terhadap peningkatan kasus cerai gugat serta meninjaunya dalam perspektif maqashid syari’ah pada hukum keluarga Islam. Dengan pendekatan kualitatif dan teknik pengumpulan data berupa wawancara dan dokumentasi, ditemukan bahwa media sosial sering menjadi pemicu konflik, baik melalui akses informasi sebagai bentuk kesadaran hukum yang memperkuat keberanian istri menggugat cerai maupun karena adanya bukti perselingkuhan dan kecedenderungan membandingkan kehidupan rumah tangga dengan pasangan lain (social comparison). Perspektif maqashid syari’ah memandang tindakan cerai gugat ini sebagai bentuk perlindungan terhadap jiwa, akal, dan perlindungan terhadap keturunan yang dapat mengancam psikologis anak. Maqashid syari’ah tidak secara langsung melegitimasi perceraian sebagai jalan keluar utama, melainkan menekankan pentingnya pencegahan konflik dan penguatan relasi dalam hubungan keluarga. The main issue addressed is how professional, transparent, and accountable zakat governance can support the economic empowerment of mustahik communities. This research adopts the position that implementing GAG based on ZCP is a strategic approach to improving the effectiveness of zakat management, which has not been comprehensively studied at the regency level. A qualitative method using a case study approach and Participatory Action Research was employed through in-depth interviews, observations, and analysis of official documents. The findings indicate that although the fundamental principles of zakat governance have been applied, there are weaknesses such as suboptimal public transparency, underperforming internal audit functions, limited digitalization, and empowerment program effectiveness that is not yet integrated with ongoing training and monitoring. This study contributes by expanding the application of Good Amil Governance principles based on the Zakat Core Principles at the district level, which has previously been rarely examined. The study also identifies various gaps in zakat governance, such as low public transparency, weak internal audit functions, and limited digitalization.</p> <p> </p> <p><em>[Penelitian ini bertujuan mengkaji penerapan prinsip Good Amil Governance (GAG) berbasis Zakat Core Principles (ZCP) pada lembaga pengelola zakat di tiga kabupaten dengan tingkat kemiskinan tertinggi di Sulawesi Barat, yaitu Polewali Mandar, Majene, dan Mamasa. Isu utama yang dibahas adalah bagaimana tata kelola zakat yang profesional, transparan, dan akuntabel dapat mendukung pemberdayaan ekonomi masyarakat mustahik. Penelitian ini mengambil posisi bahwa implementasi GAG berbasis ZCP merupakan pendekatan strategis untuk meningkatkan efektivitas pengelolaan zakat yang belum banyak dikaji secara komprehensif di tingkat kabupaten. Metode kualitatif dengan pendekatan studi kasus dan Participatory Action Research digunakan melalui wawancara mendalam, observasi, dan analisis dokumen resmi. Hasil penelitian menunjukkan bahwa meskipun prinsip dasar tata kelola zakat telah diterapkan, terdapat kelemahan seperti kurang optimalnya transparansi publik, fungsi audit internal yang belum berjalan maksimal, keterbatasan digitalisasi, serta efektivitas program pemberdayaan yang belum terintegrasi dengan pelatihan dan monitoring berkelanjutan. Penelitian ini memberikan kontribusi dengan memperluas penerapan prinsip Good Amil Governance berbasis Zakat Core Principles pada level kabupaten yang sebelumnya jarang dikaji.
